TERMS AND CONDITIONS OF SERVICE


Subject

1.1. These general terms and conditions of sale (hereinafter also the β€œConditions”) apply to the purchase of products under the Maria Maiorano Skin Care Milano Srl brand made through the e-commerce website (hereinafter the β€œSite”) by users qualifying as β€œConsumers” under Article 1.2 below. The Site is owned by Maria Maiorano Skin Care Milano Srl – VAT number: 13795590960, with registered office in Cologno Monzese (MI), Via Barcellona no. 4/6 – ZIP 20093 – Rea No.: MI – 2744030, PEC: milanoskincare@pec.it.


1.2. Purchases of Products made through the Site will be between TRIBOO DIGITALE as the seller (hereinafter the β€œSeller”) and the individual who purchases one or more Products for purposes not related to their entrepreneurial, commercial, craft, or professional activity as the buyer (hereinafter the β€œConsumer”). (Seller and Consumer are hereinafter collectively referred to as the β€œParties”).


1.3. The Owner is not a party to these Conditions but holds the rights to the domain name of the Site, the logos, and trademarks related to the Products displayed on the Site, as well as copyright for the Site’s content.


1.4. Any communication from the Consumer related to the purchase of Productsβ€”including reports, complaints, requests regarding purchase and/or delivery of Products, exercise of the right of withdrawal, etc.β€”must be sent to the Seller using the contact form on the Site, accessible by clicking the β€œAssistance” button/widget located at the bottom right of all Site pages.


1.5. Each purchase is governed by the general terms and conditions of sale in the version published on the Site at the time the Consumer submits the order.


1.6. The Site is dedicated to retail sales and is intended exclusively for Consumers. Non-Consumers are invited not to place orders. If one or more sales are made to a person who cannot be classified as a Consumer, these Conditions will still apply, but with the following exceptions:

  • The buyer will not have the right of withdrawal under Article 10;

  • The buyer will not benefit from the Product warranty indicated in Article 8;

  • The buyer will not receive other protections provided herein for the Consumer in accordance with mandatory legal provisions;

  • The sales contract concluded between the Seller and the buyer will be governed by Italian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention 1980).

1.7. By submitting the purchase order, the Consumer agrees that confirmation of the order information and these Conditions will be sent by e-mail to the address provided during registration on the Site or during the purchase process.


1.8. To make purchases through the Site, the Consumer must be of legal age (18 years) and have full capacity to act, which the Consumer declares to possess.


1.9. Any Internet connection costs, including telephone charges, are the sole responsibility of the Consumer, according to the rates applied by the chosen service provider.

Product Features and Availability

2.1. Products are sold with the features described on the Site and according to the Conditions published on the Site at the time the order is placed, excluding any other conditions or terms.


2.2. The Seller reserves the right to modify these Conditions at any time, at its discretion, without prior notice to Site users. Any changes will take effect from the date of publication on the Site and will apply only to sales concluded from that date onward.


2.3. Prices, Products, and/or their characteristics may change without notice. Such changes apply only to orders not yet confirmed at the date of the change. Before submitting an order, the Consumer is invited to verify the final sale price.


2.4. The Site can be accessed worldwide. However, Products are available for purchase only by users requesting delivery to one of the countries indicated on the Site.

How to Purchase Products – Completion of Each Purchase Contract

3.1. Product presentation on the Site, which is not binding for the Seller, represents an invitation to Consumers to make a purchase proposal and not a public offer.


3.2. The purchase order submitted by the Consumer constitutes a contractual proposal governed by these Conditions, which form an integral part of the order. By submitting the order, the Consumer agrees to accept these Conditions fully and without reservation. Before placing an order, the Consumer will be asked to carefully read these Conditions and the information on the right of withdrawal, print a copy, and save or reproduce a copy for personal use. The Consumer will also be asked to review and correct any errors in their personal data.


3.3. The Consumer’s order is accepted by the Seller via e-mail confirmation sent to the address provided during registration or at the time of order submission. The confirmation email will include these Conditions, the order summary (price, shipping costs, taxes), and the Product description. All documents will be stored electronically by the Seller, and the Consumer can request a copy by contacting the Seller.


3.4. Each purchase contract is concluded when the Consumer receives the order confirmation from the Seller by e-mail.

Product Selection and Purchase Procedure

4.1. Products can be purchased by selecting items and adding them to the virtual shopping cart. To complete the purchase, the Consumer will be prompted to (i) register on the Site, (ii) log in if already registered, or (iii) provide personal data to finalize the order. The Consumer will review and confirm all order data, approve these Conditions via a checkbox, select shipping and payment methods, and submit the order. Payment data (credit card, PayPal Express, Apple Pay) must be transmitted via secure connection. The purchase amount will be charged at the time of order confirmation.


4.2. If the Consumer notices an obviously incorrect price caused by a technical error on the Site, they should not complete the order and must report the error via the contact form (β€œAssistance” button/widget).

Delivery and Acceptance

5.1. Product availability and delivery times are indicative and not binding.


5.2. The Seller will make all efforts to meet the indicated delivery times and, in any case, deliver within 30 days from the day after the order submission. If the Product is temporarily unavailable, the Seller will notify the Consumer and refund any payments made.


5.3. Delivery will follow the Consumer’s selected method. The Consumer must promptly check that all ordered Products are included and notify the Seller of any defects. Damaged packaging should be refused or accepted β€œwith reserve.”

Prices, Shipping, Taxes

6.1. Prices include standard packaging, VAT (if applicable), and indirect taxes (if applicable), but exclude shipping, which will be added before order confirmation.


6.2. The Consumer must pay the total price as indicated in the order and confirmation.


6.3–6.6. For delivery outside the EU, the Consumer is responsible for customs duties, taxes, and any additional charges. Non-payment or refusal of Products may result in retention of Products and charges for shipping, return, customs, and taxes.

Payments

7.1. Payment must be made within 10 days from order confirmation. Execution of the contract begins when payment is credited to the Seller.


7.2. Payment methods include credit card, PayPal Express, Apple Pay, and Klarna. Additional methods may be provided on the Site.


7.3. Credit card payments are processed via Shopify Payments.


7.4. Receipts or invoices will be provided electronically or in paper form as required by law.

Legal Warranty, Defects, and Warranty Services

8.1. The Seller guarantees that Products will be free of defects and compliant with the descriptions on the Site for 2 years from delivery, in accordance with EU Directive 771/2019/EC and Italian Consumer Code (Legislative Decree 206/2005). Misuse or improper washing voids the warranty.


8.2–8.4. Consumers can report defects via the contact form, include proof and order confirmation, and request returns. Authorized returns must be made within 30 days. The Seller will repair, replace, or refund defective Products in accordance with the Consumer Code.

Liability for Defective Products

9.1. Liability follows the provisions of the Consumer Code. The Seller, as distributor, is exempt from liability by providing the producer’s details upon request.

Right of Withdrawal

10.1–10.4. Consumers may withdraw within 14 days from delivery without penalty. Costs and risks of return are borne by the Consumer. Refunds are made via the original payment method, except if another is requested. The Consumer is liable for diminished value from misuse or improper handling.

Intellectual Property Rights

11.1. All trademarks, logos, images, text, and other content on the Site are the exclusive property of the Owner or its licensors. The Consumer may not use or authorize others to use the Site for illegal purposes, copy, reproduce, distribute, or modify content in any way.

Consumer Data and Privacy

12.1–12.4. Personal data collected during registration and purchase will be used by the Seller and, if necessary, the Owner in compliance with EU Regulation 679/2016 and Italian privacy laws. Consumers must provide accurate data and may update it via the β€œMy Account” section.

Security

13.1. Despite protective measures, the Seller cannot guarantee that information on the Site is completely secure from unauthorized access.


13.2. Payment data are handled securely via Shopify Payments.

Applicable Law, Dispute Resolution, and Jurisdiction

14.1. Contracts are governed by Italian law, including the Consumer Code and Legislative Decree 70/2003 on e-commerce.


14.2. Consumers may attempt amicable conciliation via RisolviOnline.


14.3. Consumers may also use the EU Online Dispute Resolution (ODR) platform.


14.4. If conciliation fails, disputes will be submitted to the court of the Consumer’s residence or domicile.

Language of Terms and Conditions

These Conditions are published in Italian and English. In case of discrepancies, the Italian version prevails.
